1. Agreement
These Terms of Service ("Terms") govern your use of TableTop (usetable.top), a restaurant management and online ordering platform owned and operated by DIGIDARK CORPORATION ("we", "us", "our"), including this website, QR/table ordering, online ordering, pickup ordering, menus, and the staff management system (together, the "Service"). By accessing or using the Service — including by browsing a menu, placing an order via a table QR code, ordering online, or ordering for pickup — you agree to these Terms. If you do not agree, do not use the Service.
2. The platform and the Restaurant
This website is operated on the TableTop platform on behalf of the restaurant named on the home page or order page (the "Restaurant"). Menu items, prices, photographs, descriptions, offers, opening hours, and order fulfilment are the Restaurant's responsibility. DIGIDARK CORPORATION provides the software platform and is not the seller, preparer, or provider of food or beverages ordered through the Service.
3. Accounts
- Staff accounts are created and managed by the Restaurant's administrator. You are responsible for keeping your login credentials confidential and for all activity under your account.
- You must notify the Restaurant's administrator or us immediately of any unauthorised use of your account.
- We may suspend or terminate accounts that violate these Terms, compromise security, or are used unlawfully.
4. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order through the Service, or you must be using it under the supervision of a parent or guardian. Certain items (for example, alcohol or tobacco-adjacent products, where sold) may only be ordered by, and will only be served or handed over to, persons who meet the applicable legal age requirement, and the Restaurant may require valid government-issued proof of age at the time of collection or delivery and may refuse service if this cannot be verified.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Attempt to gain unauthorised access to any part of the Service, other accounts, or connected systems;
- Interfere with or disrupt the Service, including by probing, scanning, or overloading it;
- Copy, scrape, resell, or reverse engineer the platform or its software;
- Upload content that is unlawful, infringing, defamatory, or harmful; or
- Misuse ordering features, including placing fraudulent, duplicate, or bad-faith orders, or orders you do not intend to honour or collect.
6. Orders and payment
- An order placed through the Service — whether via a table QR code, online ordering, or pickup ordering — is an offer to purchase from the Restaurant and is subject to the Restaurant's acceptance, item availability, and kitchen capacity at the time.
- The Restaurant may accept, decline, or cancel any order, in whole or in part, at its discretion, including where an item has run out, where details provided (name, phone number, address) appear inaccurate or fraudulent, where there are pricing or listing errors, or where the order falls outside its service area or hours.
- Prices are as displayed at the time of ordering and may include applicable taxes, packing charges, delivery charges, and other charges as shown at checkout. Prices, menus, and availability may change without prior notice and may vary from what is shown due to caching, connectivity, or timing.
- Online and card/UPI payments are processed by third-party payment gateways under their own terms and privacy policies; we do not store your full card, banking, or wallet credentials on our servers.
- You are responsible for reviewing your order (items, quantities, customisations, and total) before submitting it. Once an order is accepted by the Restaurant, changes or cancellations may not always be possible.
- Cancellations and refunds are governed by our Refund & Cancellation Policy.
7. Menu content, images, and descriptions
- Images are for illustration purposes only. Photographs of dishes, drinks, packaging, and combos are serving suggestions and may differ from the actual item due to presentation, portioning, garnish, plating, packaging, ingredient substitutions, seasonal availability, or the Restaurant's own preparation practices. The item served may not visually match the image shown.
- Descriptions may be generated or assisted by artificial intelligence (AI). Some menu item names, descriptions, tags, translations, or recommendations displayed on the Service may be generated in whole or in part by automated or AI-based tools. Such content is provided for general convenience only, may contain inaccuracies, omissions, or errors, and does not constitute a guarantee, warranty, or binding representation of the actual ingredients, preparation method, portion size, origin, nutritional content, or quality of any item.
- Neither DIGIDARK CORPORATION nor the Restaurant warrants that images or descriptions (whether written by staff or generated by AI) are complete, accurate, current, or free of error, and both expressly disclaim liability for any decision made in reliance on such content, to the maximum extent permitted by law.
- If you have any doubt about the contents, ingredients, preparation, or suitability of any item — including for allergy, dietary, religious, or medical reasons — you must confirm directly with the Restaurant's staff before ordering or consuming it, and should not rely solely on images, descriptions, or AI-generated content.
- Menu items, combos, prices, and availability are subject to change at any time without notice and may vary by location, time of day, or stock on hand. Colours, fonts, and layout on your device may also differ from what is described here due to browser, screen, or connectivity differences.
8. Pricing, taxes and charges
Displayed prices are set by the Restaurant and may include or exclude applicable taxes (such as GST), service charges, packing/handling charges, delivery charges, platform or convenience fees, and gratuities, as shown at checkout before you confirm your order. Any discrepancy between a previously advertised price and the price shown at checkout will be resolved in favour of the price shown at checkout at the time of order confirmation. Service charges, where applied, are collected by the Restaurant and are separate from any voluntary tip you may choose to give.
9. Allergens and dietary information
While the Restaurant may provide allergen or dietary indicators (such as "veg," "non-veg," "contains nuts") as a convenience, food is prepared in kitchens that may also handle gluten, nuts, dairy, eggs, soy, shellfish, and other common allergens, and cross-contamination is possible. DIGIDARK CORPORATION and the Restaurant do not guarantee that any item is free of a particular allergen or ingredient. If you have a food allergy, intolerance, or medical dietary requirement, you are responsible for informing the Restaurant's staff directly before ordering, and you order at your own risk if you do not do so.
10. Delivery and pickup
- Estimated preparation, pickup, and delivery times shown on the Service are approximate and are not guaranteed; actual times may vary due to order volume, traffic, weather, staffing, or other factors outside our or the Restaurant's control.
- For pickup orders, you are responsible for collecting your order within the timeframe communicated by the Restaurant. The Restaurant may charge for or dispose of uncollected orders in accordance with its own policy.
- For delivery orders, you are responsible for providing an accurate delivery address and contact number and for being reasonably available to receive the order. Delivery may be limited to a serviceable radius shown on the Service.
- Delivery-specific terms are set out in our Delivery Policy.
11. Cancellations, refunds and no-shows
Cancellation windows, refund eligibility, and how refunds are processed (including for non-delivery, incorrect items, no-shows on pickup orders, or Restaurant-side cancellations) are set out in our Refund & Cancellation Policy, which forms part of these Terms.
12. Coupons, offers and promotions
Coupons, discount codes, and promotional offers are provided at the Restaurant's discretion, may be time-limited, restricted to certain items, order values, or customers, may not be combined unless stated, and may be withdrawn or modified at any time without notice. We and the Restaurant reserve the right to refuse or reverse a discount that was applied due to a technical error or misuse.
13. Intellectual property
The TableTop platform, including its software, design, and branding, is the property of DIGIDARK CORPORATION and is protected by applicable intellectual property laws. Restaurant content (menus, photos, logos, descriptions) belongs to the Restaurant or its licensors. No rights are granted to you except the limited right to use the Service as intended for browsing and placing orders.
14. Service availability
We aim to keep the Service available and reliable, but it is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, timely, secure, or error-free operation, and we may modify, suspend, or discontinue features (with reasonable notice where practicable) for maintenance, upgrades, or security reasons.
15. Disclaimer of warranties
To the maximum extent permitted by law, the Service, and all menu content, images, descriptions, and information made available through it, are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Neither DIGIDARK CORPORATION nor the Restaurant warrants that the Service will be error-free or that any defects will be corrected.
16. Limitation of liability
To the maximum extent permitted by law, DIGIDARK CORPORATION shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business, arising from your use of or inability to use the Service, or from any menu image, description, or AI-generated content proving inaccurate or incomplete. Nothing in these Terms limits liability that cannot be limited under applicable law. The quality, safety, hygiene, ingredients, preparation, packaging, and legality of food and beverages are the sole responsibility of the Restaurant that prepares and sells them, and any claim relating to the food or beverages themselves should be directed to the Restaurant.
17. Indemnity
You agree to indemnify and hold harmless DIGIDARK CORPORATION and, where applicable, the Restaurant, from and against any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or the information you provide when placing an order.
18. Force majeure
Neither DIGIDARK CORPORATION nor the Restaurant will be liable for any delay or failure to perform caused by events beyond reasonable control, including natural disasters, fire, flood, extreme weather, strikes, civil unrest, power or internet outages, third-party service failures, government action, or public health restrictions.
19. Third-party links and services
The Service may link to or rely on third-party services (for example, maps, payment gateways, delivery partners, or messaging providers). We are not responsible for the content, accuracy, or practices of third-party services, and your use of them is subject to their own terms and privacy policies.
20. Electronic communications
By placing an order or otherwise using the Service, you consent to receive order confirmations, updates, and related communications electronically (including via SMS, WhatsApp, email, or in-app notification) at the contact details you provide. Such communications satisfy any legal requirement that they be in writing.
21. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of assets without your consent.
22. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
23. Waiver
No failure or delay by us in exercising any right under these Terms will operate as a waiver of that right, nor will any single or partial exercise of a right preclude any other exercise of it.
24. Entire agreement
These Terms, together with our Privacy Policy, Cookie Policy, Refund & Cancellation Policy, and Delivery Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings, whether written or oral, on the same subject.
25. Privacy
Your use of the Service is also governed by our Privacy Policy and Cookie Policy.
26. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to Section 27, any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in India.
27. Dispute resolution
If a dispute arises out of or relating to these Terms or the Service, you agree to first contact us at support@usetable.top so we can attempt to resolve it informally. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief before a competent court where appropriate.
28. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Continued use of the Service, including placing any further order, after changes take effect constitutes acceptance of the revised Terms.
